Legal Resources Update

Cybersecurity Liability
A private entity is not liable in a class action lawsuit resulting from a cybersecurity event unless it was caused by willful and wanton misconduct or gross negligence on the part of the private entity. Review our Law Guide topic, E-health, to fully understand what is and is not included in this law.  

Doctor Shopping Guide
If a prescriber has actual knowledge that a patient has knowingly, willfully and with an intent to deceive, obtained or attempted to obtain a controlled substance or one with similar therapeutic use within the previous 30 days from another prescriber, the patient must be reported to law enforcement. Prescribing for Self & Family: BME Policy
The licensing boards for physicians each have a policy that prohibits an M.D. or D.O. from prescribing or treating himself/herself and treatment of immediate family and treatment by supervisees.
